## 1. Acceptance of Terms
By accessing or using monarchespresso.com (the "Site") or placing an order with Monarch Espresso Bar ("Monarch," "we," "us," or "our"), you agree to these Terms & Conditions. If you don't agree, please don't use the Site or place an order.
## 2. About These Terms
These Terms apply to all visitors, customers, and users of the Site, including anyone who places an online order, joins Coffee Club, purchases a gift card, downloads a digital recipe, buys merch, or books an event with us.
## 3. General Conditions
We reserve the right to refuse service to anyone, for any reason, at any time.
Information you submit through the Site (not including credit card information) may be transferred unencrypted and may involve transmission over various networks, and adaptation to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer.
The section headings used in these Terms are for convenience only and don't limit or otherwise affect these Terms.
## 4. Accuracy of Site Information
We aren't responsible if information on the Site is inaccurate, incomplete, or out of date. Content on the Site — including menu descriptions, event pricing, and recipe information — is provided for general information only and shouldn't be relied on as the sole basis for a decision. Any reliance on Site content is at your own risk.
The Site may contain outdated information at times (for example, past event photos or seasonal offerings). We reserve the right to modify Site content at any time without obligation to update it, and it's your responsibility to check back for current information.
## 5. Orders, Pricing & Billing
Online ordering is processed through our third-party ordering partner (Square). By placing an order, you agree to that provider's applicable terms in addition to ours.
Prices and availability for products, subscriptions, and services are subject to change without notice, and we reserve the right to correct pricing or listing errors — including after you've submitted an order.
We reserve the right to refuse, limit, or cancel any order, including limiting quantities purchased per person, household, or order, and including orders that we believe, in our sole judgment, are being placed for resale or distribution rather than personal use. If we cancel or change an order, we'll try to reach you using the contact information provided at checkout.
You agree to provide current, complete, and accurate information for any purchase, and to keep your contact and payment information up to date so we can complete transactions and reach you if needed.
## 6. Coffee Club Subscription
Coffee Club is a recurring subscription. By subscribing, you authorize us to charge your payment method automatically each billing cycle (monthly, or every 6 months if you select that plan) until you cancel. You can cancel at any time; cancellation takes effect at the end of your current billing period, and we don't provide refunds for partial periods already paid.
## 7. Gift Cards
Gift cards are issued and processed through our third-party partner (Square) and are subject to that provider's terms. Gift cards are non-refundable and cannot be redeemed for cash except where required by law.
## 8. Digital Downloads (Recipes)
Recipe PDFs and other digital downloads sold on the Site are licensed to you for personal, non-commercial use only. You may not resell, redistribute, or publish these materials as your own. All recipes and related content remain the property of Monarch.
## 9. Products & Merchandise
We've made every effort to accurately display the colors and details of merchandise (hats, sweatshirts, granola, and similar items) on the Site, but we can't guarantee that your device's display will show colors exactly as they appear in person.
We reserve the right, but have no obligation, to limit sales of any product to any person, geographic area, or jurisdiction, to limit quantities available, and to discontinue any product at any time without notice. We don't warrant that any product will meet your expectations.
## 10. Events & Space Rental
Event bookings are subject to availability and require confirmation from us before a date is considered reserved. Pricing, capacity limits, and add-on services (such as an onsite barista) are as quoted at the time of booking and are subject to change. Outside food and non-alcoholic beverages are permitted at event bookings unless otherwise noted; alcohol is not permitted on the premises without an approved special event license.
## 11. User Comments, Reviews & Testimonials
If you send us comments, reviews, drink suggestions, or other feedback — whether we asked for it or not — you agree that we may use, edit, and publish what you share (for example, on the Site or in marketing) without compensation or obligation to keep it confidential. We're under no obligation to respond to or act on feedback submitted.
You agree that anything you submit won't violate someone else's rights (including copyright or privacy), won't be unlawful, abusive, or obscene, and won't misrepresent who you are. You're solely responsible for the accuracy of anything you submit, and we take no responsibility for user-submitted content.
## 12. Intellectual Property
All content on the Site — including text, photos, logos, recipes, and design — is owned by Monarch or used with permission, and is protected by copyright and trademark law. You may not copy, reproduce, duplicate, sell, resell, or otherwise exploit any portion of the Site or access to it without our express written permission.
## 13. Third-Party Links & Tools
The Site links to or integrates with third-party services and tools (including Square, DoorDash, and Instagram). We don't control these services, don't monitor them, and aren't responsible for their content, accuracy, policies, or practices — they're provided "as is," without endorsement. Use of any third-party service is entirely at your own risk and is subject to that provider's own terms. Complaints about a third-party product or service should be directed to that third party, not us.
## 14. Personal Information
Any personal information you submit through the Site is handled according to our Privacy Policy.
## 15. Prohibited Uses
You may not use the Site: for any unlawful purpose; to violate any applicable law or regulation; to infringe our intellectual property or anyone else's; to harass, abuse, or discriminate against others; to submit false or misleading information; to upload viruses or malicious code; to collect other people's personal information without consent; to spam, scrape, or crawl the Site; or to interfere with or bypass the Site's security features. We reserve the right to terminate your access to the Site for violating any of these.
## 16. Disclaimer of Warranties; Limitation of Liability
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Site will be uninterrupted, timely, secure, or error-free, or that any results from using it will be accurate or reliable.
To the fullest extent permitted by law, Monarch and our employees, contractors, and agents are not liable for any indirect, incidental, special, punitive, or consequential damages — including lost profits or lost data — arising from your use of the Site or any product or service purchased from us, even if we've been advised of the possibility of such damages. Some states don't allow the exclusion of certain warranties or the limitation of certain damages, so some of the above limits may not apply to you; in those cases, our liability is limited to the fullest extent the law allows.
## 17. Indemnification
You agree to indemnify, defend, and hold harmless Monarch and our officers, employees, contractors, and agents from any claim or demand — including reasonable attorneys' fees — arising from your breach of these Terms, your violation of any law, or your violation of a third party's rights.
## 18. Severability
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the rest of these Terms will remain in full effect.
## 19. Termination
These Terms remain in effect until terminated by you or us. You may stop using the Site at any time. We may terminate or restrict your access at any time, without notice, if we believe you've violated these Terms — and you'll remain responsible for any amounts owed as of the termination date.
## 20. Entire Agreement
Our failure to enforce any part of these Terms doesn't waive our right to enforce it later. These Terms, along with any policies posted on the Site (including our Privacy Policy), make up the entire agreement between you and Monarch regarding your use of the Site, and supersede any prior agreements or communications on the subject.
## 21. Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles.
## 22. Changes to These Terms
We may update these Terms from time to time by posting changes to the Site. Continued use of the Site after changes are posted means you accept the updated Terms.
